Minimization of Taxes 2017 by Legal Means
03.11.2017

Managing Partner of WinnerLex Law Firm, Anna Vinnichenko, was a speaker at the event “MINIMIZATION OF TAXES 2017 BY LEGAL MEANS,” organized by the Business Club on November 2-3, 2017. During her presentation, she demonstrated legitimate tax planning schemes and models for optimizing taxes within the framework of current legislation, while minimizing risks with controlling and law enforcement authorities.
An important feature of the presentation was its practical nature: using concrete examples from won tax disputes, the speaker addressed the risks and provided practical recommendations to the participants on the following issues:
- Typologies of “risky” schemes from the perspective of the State Fiscal Service (SFS) and the State Financial Monitoring Service
- Recognition of business operations as “unreal, fictitious, null, or non-existent”: criteria and consequences
- How SFS and the State Financial Monitoring Service track and identify tax minimization schemes and the work of optimization companies
- Risks of working with sole proprietors: withdrawal of financial assistance and requalification into regular employees
- What should be considered in contracts with counterparties to minimize tax risks
- Criteria for entering the SFS planned inspection schedule (Ministry of Finance Order No. 524)
- Risky cash transactions and their blocking by banks according to the State Financial Monitoring Service
- Common mistakes made by real businesses that trigger unplanned tax audits
- 7 steps for proper challenging of tax notifications (PPR)
- Using positive and negative court rulings in similar disputes.
Given the active response from the participants, it is clear that many of the issues discussed were both useful and relevant to them, which is why we have decided to hold more in-depth events in the near future, about which we will inform you.
